The terms and conditions outlined below (this “Agreement”) establish a legal agreement between you (the “Customer”) and LocaleClean Inc (the “Company”). By using or receiving any goods or services provided by LocaleClean Inc (collectively, the “Services”)—which includes accessing the website located at https://localeclean.com and any associated software or mobile application (the “Software”)—you, the Customer, explicitly acknowledge and agree to abide by the terms and conditions of this Agreement, as well as any amendments made to it, which will be posted from time to time on https://localeclean.com/terms-and-conditions.
LocaleClean Inc reserves the right to modify the terms and conditions of this Agreement or its policies related to the Services or Website at any time, with such modifications becoming effective upon posting an updated version of this Agreement on https://localeclean.com/terms-and-conditions. It is the Customer’s responsibility to review this Agreement regularly. Continued use of the Service or Website after any such changes constitutes acceptance of the modified terms.
Eligibility
LocaleClean Inc’s services are available only to individuals aged 18 years and older who can legally form binding contracts. By using our Services, you represent that you are at least 18 years old and that all information you provide is accurate and truthful. LocaleClean Inc may, at its discretion, refuse access to the Site or Services to any individual or entity and may update its eligibility criteria as needed. Individuals under 18 must use the Services only under the supervision of a parent or legal guardian who is at least 18 years old. In such cases, the adult assumes full responsibility for any activities.
Compliance and Conduct
You agree to comply with all local laws regarding online conduct and the content you provide. You are responsible for all applicable taxes. Additionally, you must adhere to LocaleClean Inc’s policies as outlined in this Agreement and any other rules or guidelines published by LocaleClean Inc on the Site. These policies may be updated without prior notice.
Authority
By utilizing the Services, you agree that:
- You have the authority to form a binding contract with LocaleClean Inc;
- You will comply with all applicable local, state, national, and international laws, rules, and regulations; and
- You acknowledge that LocaleClean Inc is protected by trademark and copyright laws.
If you are using the Services on behalf of a business or other entity, you represent that you are authorized to agree to these Terms on behalf of the business or entity.
Service Overview
LocaleClean Inc provides a platform for Customers to schedule eco-friendly cleaning services, with Providers assigned to complete the requested services. When a service is booked, LocaleClean Inc may pre-authorize the Customer’s payment card. LocaleClean Inc assigns providers based on their availability, location, and other criteria. Upon completion of the service, LocaleClean Inc processes payment from the Customer and compensates the service providers. LocaleClean Inc collects a commission for facilitating these transactions.
It is free to register on LocaleClean Inc’s platform. Both Customers and Providers must complete a registration process, with Providers undergoing a background check and verification of credentials, such as licenses, before they are eligible to offer services.
LocaleClean Inc is an intermediary and not a direct party to agreements between Customers and Providers. The Company is not responsible for the performance, quality, or conduct of either party. Disputes arising between Customers and Providers must be resolved directly between those parties. LocaleClean Inc is not liable for the completion or outcome of services. Additionally, LocaleClean Inc does not guarantee the availability of service providers or the satisfaction of services rendered.
Disclaimers and Safety
While LocaleClean Inc strives to verify the credentials of its listed service providers, it does not guarantee the accuracy or completeness of this information. Customers are responsible for evaluating a provider’s qualifications and suitability. LocaleClean Inc does not endorse or recommend any specific service provider. Any contracts or agreements made between a Customer and a service provider are at their discretion, and LocaleClean Inc has no involvement in the terms of such agreements.
LocaleClean Inc is not responsible for disputes between Customers and service providers and does not have any obligations in these matters. Customers are advised to take necessary safety precautions before engaging a service provider, including verifying credentials and performing background checks.
Pricing and Payment
LocaleClean Inc reserves the right to modify its pricing and discount policies at any time. Any changes in pricing will take immediate effect unless otherwise specified. Services booked prior to a pricing change will typically retain their original pricing unless modifications are made. Prices include LocaleClean Inc’s commission, which may vary.
Services are priced per service or by the hour. If a service is billed hourly, the minimum hourly charge will apply even if the service is completed in less time. Any additional time will be charged on a prorated basis.
Service Conditions
LocaleClean Inc’s pricing applies to properties that are in average condition. Additional fees may apply for properties requiring more intensive cleaning or services beyond the standard scope of work. This includes situations such as:
- Excessively greasy or soiled surfaces,
- Heavily disorganized spaces,
- Disposal of large amounts of waste,
- Biohazards, or
- Pathological waste.
LocaleClean Inc reserves the right to offer additional services outside the initial scope of work as needed, and the Customer will be informed of any additional charges.
Liability Waiver
LocaleClean Inc is not liable for any damages or claims arising from disputes between Customers and service providers. You agree to release LocaleClean Inc, its officers, directors, employees, agents, and affiliates from any claims, damages, or disputes arising from your interactions with service providers.
Card Pre-Authorization
When you schedule a Service with LocaleClean Inc, we may pre-authorize the full payment on your payment card twenty-four (24) hours prior to your scheduled service date. A Service appointment will only be confirmed once the pre-authorization is successfully processed. If the Service is canceled, or upon final payment, this pre-authorization will be released. LocaleClean Inc reserves the right to pre-authorize the full amount of your agreed service rate. Should your payment card be declined and we are unable to secure the pre-authorization within twenty-four (24) hours of your Service, the appointment will automatically be canceled.
Payment
Upon completion of the Service, LocaleClean Inc will calculate the final amount to be paid, including any applicable discounts. The Customer can either release the payment or LocaleClean Inc will automatically process it. The Customer agrees to maintain sufficient funds in their account to cover the final amount and should only post a Service request if they can pay for it. At our discretion, we may prevent a Customer from posting a Service if there are outstanding payments from prior Services. LocaleClean Inc does not accept cash payments. All payments for Services must be processed using a valid payment card, and the final payment will be charged once the Service is completed. LocaleClean Inc reserves the right to reject certain payment methods, including pre-paid cards. Providers are typically paid up to 10 business days after the Customer has made the final payment, with the funds deposited directly into the Provider’s designated bank account.
Payment Services
LocaleClean Inc may use third-party Payment Services at its discretion to facilitate payment card processing. While LocaleClean Inc ensures that these Payment Services comply with financial regulations, the Company is not responsible for the performance of these Payment Services. LocaleClean Inc does not directly store or manage payment card information. The fees for using the Payment Services will be covered by LocaleClean Inc.
